Acceptance of Terms

DayZ of Oblivion (“DayZ of Oblivion,” “DOB,” “we,” “us,” or “our”) provides access to its website, Discord community, game servers, donation systems, support systems, and related community services. By accessing or using any DOB community service, you agree to these Terms of Service and any related community rules or privacy policies.

If you do not agree to these terms, do not use the website, Discord, game servers, or any DayZ of Oblivion community services.

DOB may update these terms at any time. Updates may be posted on the website, Discord, or other official community locations. Continued use of the community after changes are posted means you accept the updated terms.

Registration and Community Access

You agree to represent yourself accurately and truthfully when interacting with DOB, registering for services, opening tickets, making purchases, or participating in the community.

Certain parts of the community may require registration through DOB or third-party services. Information submitted through third-party services is handled by those providers. DOB is not responsible for the privacy practices, outages, errors, or data handling of third-party registration, payment, or hosting systems.

You are responsible for maintaining the security of your account, username, password, platform account, Discord account, Steam account, and any related login credentials. You are responsible for all activity that occurs through your account.

Community Conduct

You agree to act responsibly, follow staff direction, and treat other members with respect. You are solely responsible for anything you post, upload, transmit, say, or share through the community.

You may not upload, post, transmit, distribute, or publish content that is unlawful, harmful, defamatory, obscene, vulgar, pornographic, threatening, harassing, hateful, abusive, discriminatory, invasive of privacy, or otherwise objectionable.

You may not encourage criminal activity, violate another party’s rights, impersonate another person or group, distribute spam or unauthorized promotions, harm minors, share malicious files, or upload software designed to interrupt, damage, or limit computer systems or services.

Submissions and Community Content

By submitting feedback, suggestions, reviews, graphics, media, public posts, server ideas, or other materials to DOB, you grant DOB a worldwide, royalty-free, non-exclusive, perpetual license to use, display, modify, reproduce, publish, distribute, and create derivative works from those submissions for community purposes.

You represent that you have the right to submit the content and that your submissions do not violate another person’s copyright, trademark, privacy rights, or intellectual property rights.

DOB may edit, refuse, remove, disclose, or preserve submissions when needed for moderation, safety, legal compliance, server operation, or community management.

Donations, Support, and In-Game Services

DOB may accept voluntary donations and support from community members to help maintain servers, hosting, development, graphics, events, and community operations. Donations are not required to access the community unless a specific service or package states otherwise.

Certain support packages may include custom graphics, queue priority, cosmetics, in-game services, packages, accessories, or other community benefits. Availability, delivery, and continued use may depend on server rules, wipes, technical limitations, staff approval, and official monetization policies.

In-game donations and packages must follow Bohemia Interactive monetization and fair-use policies. Items or benefits may need to be available in a way that complies with official DayZ server monetization requirements.

Payments

The primary online payment method used by DOB is PayPal. Payment disputes, chargebacks, claims, and reversals must be handled through PayPal’s dispute system when applicable.

DOB may require users to open a Discord ticket or contact staff before purchasing custom work, textures, or special items so staff can confirm the request is possible.

Custom Graphics, Textures, and Untexturable Items

Not all items can be textured, modified, converted, or customized. Some items may have mirrored parts, locked materials, missing texture paths, mod-owner restrictions, file limitations, or technical issues that prevent proper customization.

This may apply to modded items or vanilla items. The GFX team may work with you to find a replacement, credit, or alternate solution when possible.

Please inquire about custom items before paying. This helps prevent situations where an item cannot be completed exactly as requested.

Refunds and Chargebacks

Due to the digital nature of custom work, donations, server support, graphics, priority services, and in-game benefits, all donations and purchases are generally non-refundable.

Chargebacks or refund attempts based on rage quitting, bans caused by your own actions, cheating, rule violations, buyer’s remorse, or deciding you no longer want the product after delivery may be disputed by DOB and may result in a ban from DOB communities.

If an item cannot be textured or completed because of technical limitations, DOB may attempt to provide a replacement, credit, or alternate solution. A one-time refund may be considered only if no reasonable solution can be found. Future similar issues may be handled as credit or replacement instead of refund.

Users who abuse refund or chargeback systems may be prohibited from future monetary support, except where platform-based support such as Discord boosts is separately handled by that platform.

Status, Wipes, and Inactivity

The game server operates with limited storage, memory, and file space. Each custom item, file, and in-game asset uses server resources.

Custom in-game items may remain available while the purchaser is active on the server unless a time limit is stated, such as priority queue days or limited-time services.

After one full wipe session or three months of inactivity, whichever is longer, custom in-game items may be removed to save memory and file space. Removal decisions may consider server usage, community demand, communication with staff, technical limits, and server needs.

Backups are not guaranteed. If an item was removed and the original files still exist, re-adding it may require a new donation or discounted re-add fee depending on staff approval and community standing. Bans do not automatically require item removal, but banned users may not be eligible to donate again.

Discord Boosts

Discord boosting may provide a Booster role or related Discord benefits. Boosts are handled through Discord and are not treated the same as direct donations because Nitro users may receive monthly boosts through Discord.

Discord boost refund policies are controlled by Discord, not DOB.

Refusal of Items or Services

DOB may refuse to create, deliver, or approve custom items, graphics, textures, packages, or services for reasons including copyright or trademark concerns, offensive or inappropriate content, technical limitations, conversion issues, unsupported file formats, poor compatibility, or requests outside staff capability.

DOB may refuse designs that imitate protected logos, brands, existing artwork, copyrighted content, trademarks, or content that may harm the reputation of the community.

DOB may also refuse requests that are too complex, incompatible with the server, unsupported by available tools, or likely to produce poor results.

Proprietary Rights

DOB, its affiliates, staff, creators, or licensors own or control rights in community branding, website design, user interface, text, graphics, artwork, videos, photographs, logos, server-related media, sound, music, code, files, and overall look and feel where applicable.

You may not copy, reproduce, repost, publish, display, distribute, modify, mirror, scrape, or exploit DOB content without prior permission, except for personal non-commercial viewing or printing where allowed.

Automated scraping, deep linking, page scraping, framing, or similar methods used to copy or enclose DOB content are prohibited unless expressly allowed.

Copyright and DMCA Claims

DOB respects third-party intellectual property rights and may investigate copyright complaints or claimed infringement under applicable law.

Copyright notices should identify the copyrighted work, the allegedly infringing material, contact information for the complaining party, a good-faith statement that the use is unauthorized, a statement that the information is accurate under penalty of perjury, and a physical or electronic signature from a person authorized to act for the rights holder.

Links and Third-Party Sites

DOB may provide links to third-party websites, platforms, launchers, payment processors, Discord, or other services. These links are provided for convenience only.

DOB does not control, monitor, endorse, or accept responsibility for third-party websites, services, materials, outages, payments, disputes, content, or policies. You access third-party services at your own risk.

DOB may allow advertisements, promotions, or outside links. Any dealings with third parties are solely between you and that third party.

Third-Party Components

Using DOB services may require third-party equipment, software, accounts, internet access, operating systems, browsers, game clients, launchers, mods, Discord, Steam, PayPal, or other services.

DOB is not responsible for issues caused by third-party components, outages, user hardware, software conflicts, internet problems, platform restrictions, or account issues.

Disclaimer

DOB communities and services are provided “as is,” “as available,” and “with all faults.” DOB makes no guarantee that the website, Discord, server, mods, services, files, or community systems will be uninterrupted, secure, error-free, virus-free, or always available.

DOB does not guarantee the accuracy, usefulness, quality, suitability, truth, completeness, or reliability of community information, posts, user content, linked websites, products, or services.

You assume all risks connected to your use of DOB services, third-party links, downloads, mods, community content, or information obtained through the community.

Limitation of Liability

To the fullest extent permitted by law, DOB, its staff, affiliates, officers, directors, employees, agents, licensors, and community representatives will not be liable for indirect, punitive, special, incidental, consequential, or exemplary damages, including lost profits, revenue, goodwill, data, use, business, or other economic losses.

This limitation applies to damages arising from use or inability to use the community, third-party conduct, unauthorized access, malicious behavior, false transactions, downloaded content, modified files, user reliance on information, or services obtained through DOB or linked websites.

To the fullest extent permitted by law, DOB’s aggregate liability for claims related to the community or services is limited to the amount you paid directly to DOB, where applicable.

Indemnification

You agree to defend, indemnify, and hold harmless DOB, its staff, affiliates, predecessors, successors, officers, managers, agents, licensors, and employees from claims, demands, losses, damages, expenses, and reasonable attorney fees arising from your use of the community, violation of these terms, misconduct, submissions, or violation of another party’s rights.

You agree not to hold DOB responsible for actions, omissions, statements, disputes, or misconduct by other users.

Violations and Termination

DOB may terminate, suspend, restrict, ban, remove access, remove content, or block future access to any DOB community without prior notice and without refund for violations of these terms, server rules, Discord rules, staff decisions, cheating, chargeback abuse, harassment, or other harmful conduct.

Waiver, Severability, and Governing Law

Failure by DOB to enforce any part of these terms does not waive the right to enforce those terms later.

If any provision is found invalid or unenforceable, the remaining provisions remain in effect and the invalid provision may be replaced with a valid provision that best reflects the original purpose.

Disputes related to the community or these terms are governed by the laws of the state where the server owner resides, without regard to conflict-of-law rules, unless otherwise required by law.

User Disputes and Release

You are responsible for resolving disputes with other users. DOB has no obligation to intervene but may choose to do so at its sole discretion.

You agree to report misconduct to DOB staff promptly. You release DOB and its related parties from claims, demands, and damages arising from user disputes, community use, services, or property made available through the community.

Miscellaneous

You may not assign these terms or your rights under them without permission. No agency, partnership, employment, or joint venture is created by these terms.

DOB is not liable for failure or delay caused by events outside its reasonable control, including war, natural disasters, outages, government action, third-party failures, software issues, hardware issues, power failures, internet routing issues, or connectivity failures.

These Terms of Service, along with applicable community rules and privacy policies, form the agreement between you and DOB regarding the community. You should save or print a copy for future reference.
